As will be shown here, HECO had numerous opportunities to make Scott Goold aware of their substance abuse policy. Their own rules required the company to inform him. And, for the safety of Scott, as well as his managers, colleages, the company and general public, HR and corporate compliance had a duty to educate Scott. They were reckless and endangered all employees. They discriminated against Scott, who was a legal medical patient.

Please follow the enclosed Background Check instructions for Applicants beginning on page 2 to begin the background check process. Also, please complete, sign and return the attached “Sponsor and Contractor IT Compliance Acknowledgement form” to me so that we can start setting up your HECO computer and network access.

Our office is located on the 12th floor of the Pacific Park Plaza. Our address is 711 Kapiolani Blvd, but the entrance to the building is on Cooke Street. We are right on the bus line on Kapiolani Blvd and right in the middle of Downtown and Ala Moana/Waikiki.

Supervisor Lori Yafuso provided overview of benefits in January 2019 when the department asked Scott to apply for the open internal position [download].

Substance Abuse concerns or policy is not mentioned. Nobody from the company made available the HECO Substance Abuse Policy to Scott, as required.

[1] HECO required Scott to complete a Sponsor and Contractor form, which included the following required policy information.

Substance Abuse Policy was also required to be made available, but not included in the list. Failure by management created a hostile work environment for Scott, recklessly endangered Scott and his coworkers, and led to the humiliating termination on February 25, 2019.

[2] Hawaiian Electric Contractor Background Check Application Instructions

HECO required Scott to provide information collected through this online application to be used to conduct a background check for security access with Hawaiian Electric Company. Please make sure all *required fields are filled out. HECO was mandated to provide substance abuse policy, but neglected Scott's safety and that of his colleagues and coworkers.

Sponsors: This document is to be sent to the contractor's employer for delivery to the contractor. The contractor shall use these instructions to log onto the BIS website, acknowledge the disclaimer, and enter their personal information.

Nobody from the company made available the HECO Substance Abuse Policy to Scott, as required.


[3] HR director Shana Buco informed Scott he was selected: "We are pleased to offer you the Database Analyst position with Hawaiian Electric Company, Inc. (HECO). [4] Elizabeth Dear contacted Scott to arrange the pre-employment drug screen. Scott was willing, but concerned about distance. He informed Dear he was disabled and injured; that he could not walk far. Dear did not make available the HECO Substance Abuse Policy as required — even though she was preparing Scott for the company pre-employment drug screen.

Dear provided Scott the address to the Straub Occupational Health facility during their phone conversation. Scott googled the location.

Scott emailed Liz and requested to speak to her privately. Dear gave him her direct line: 808-202-5241. Scott contacted Dear February 14, 2019 at 9:45 AM for a three-minute phone conversation. Scott wanted to be sure the company permitted medical cannabis. Dear told Scott he would be fine.
